Bharat-Pak Match: not a war!!!

67 Kashmiri Students are being suspended from a UP University Supporting Pakistan in Bharat-Pak Match. It is one of the most important news of yesterday which is dumped because of election news. We cannot and should not leave this issue and move forward. It is a very sensitive matter which should be looked carefully, atleast an analysis is must. My soul asked me to express my views and hence I am using my blog to express views regarding this. It becomes very important to me because I am one person who is considered to be hardcore supporter of RSS in my society, and as the common belief is that RSS supports such action as it is completely anti-Pakistan. But you will find the difference while reading this.

Let us first analyze the facts of this case, 67 students being suspended for supporting Pakistan in Bharat-Pak Match in Asia Cup. The University is ‘Subharti University’ of Meerut. The version which has been put up by the university is that the kashmiri students were supporting Pakistan in the One-Day International Match being played between India and Pakistan in Asia Cup. After Pakistan won the match there were celebrations and clash erupted between local students and Kashmiri Students. Reports suggest that the students vandalized the hostel property and when names were asked by the official students denied to give the names. There were also cheering of “Pakistan Zindabad” and other activities which were considered by the college as anti-national and Meerut being a communally sensitive area the students were suspended and left and Ghaziabad and New Delhi Railway stations with police cover[1].

Now analyzing the case in bits-n-pieces, being a Law student it is my duty to ask whether the action was legally justified. There is a very clear answer to it that no this was not a right action and as common man and as a Sawayamsevak also I consider it as wrong. First of all according to constitution of India every person has Right to free speech and Expression and Art 19(2) gives reasonable restriction to this saying it must not be against Sovereignty or Integrity of India, must not be against Public Order, Decency, morality or defamation, contempt etc. One cannot justify this act of University under any of these restrictions. Therefore legally it was wrong, supporters of this may say that the student’s action can be considered a seditious but I don’t think it is so. Moreover, the provision which is present in our code for sedition is itself controversial, so it should not stand. But Here I would say that if this step has been taken as pre-cautious measure to avoid any further clash or violence as University officials claim this was very much right action because it could have lead to violent riot also.

Now, coming to the practical world, I am also living in a hostel and as a common scene in my hostel too there are students who support Pakistan in the match and other student bully that guy but later they live with calm and peace together. This kind of Incident will never happen in any other match where India may be defeated by other countries except Pakistan and there are people who support other countries. We need to look into this matter as why this happens only in Bharat-Pak match. The very basic argument is that Most of the Indians are sworn enemy of Pakistan by-birth. It might be because Pakistan attacked Bharat most of the time and was created by dividing Bharat. It is also seen in the society that there are colonies in the city where people cheer for Pakistan. Common people say it is because of Religious attachment. Yes, it is one of the most important factors but are they anti-national? No it is not anti-national and one can support any country he wants in a game but being emotionally attached to it just because of religious attachments, I would without any fear condemn it because it is fact which cannot be denied that all the people of any religion are more safe and secure in this country atleast in comparison with Pakistan. If you do it, it is wrong and people will not accept it but if it is in game spirit it will be accepted. Our country is of very broad thought but the liberty of it should not be taken for granted and I can say any day in Future or Past My Bharat will be better from Pakistan in any manner. This fact has to be accepted.

But here lastly what I would like to say that this act of University and student may lead to further acknowledgment of fact for the Kashmiris that we alienate them always and it will never be fruitful and they will never want to be included in us. Support their views and try to explain with facts and not with violence. I remember once my mother went to Kashmir and there she experienced that kashmiris feel alienated and inclined towards Pak. This has to be changed and this can change only with dialogue and not violence. Finally I would say:
