law.....define and need
This is going to be my first blog, I hope that it will reach your mind and heart both. As this is my first attempt my article will not be so tempting but I am hoping that I will be able to reach you people.
Today we talk about ‘LAW’ every time and every second. We say that law is not working properly, law has deviated from its roots, and Laws should be changed. But for this we need to understand what ‘LAW’ is? Why law is needed? And how it works? How law evolutes? These are some question which I will be dealing here; I am not going to talk the technicalities of Law.
What is LAW?
If we will go by the dictionary definition ‘law is a set of rules and regulations’ but we can’t say that this is the perfect definition of law. This is a philosophical question which cannot be answered perfectly, or I would say that probably it has no answer. But may theorist tried to define it in their way which they found convenient.
There are various schools of thoughts who try to define it in their way, but I am not going to support any school of thought here.
Today we find laws as codified one, judicial remarks, but can we say that these are only law. The answer is NO, there are some “laws of nature” (that I will discuss later). At most we can say that ‘law is formal mechanism of social control’. Here I would like to state the definition of ‘Thomas Hobbes’, that I am very much fascinated with his definition that “law is formal glue that holds fundamentally disorganized societies together”.
Above I was talking about laws of nature, these are not at all codifies laws but still they are effective in the society. For e.g. ‘ if we violate the laws set by environment ,i.e. not to cut many trees , not play to play with fire , water we are penalized by the environment.’ So what we will say to this. These also regulate the life of human being in the society.
Now other example is customs (i.e. also a source of law), customs are also not codified but still a person in society fears to violate them.
The next in this line is “DHARMA”. There is no English word for this, so I have to use it in this manner only. Dharma is also laws of life, it also guides and controls human behavior, dharma is set of bindings which a human being is ought to follow for his/her good and peaceful life.
The other thing I would like discuss here is religious laws , every religions have their laws for good conduct of human behavior in the society. So religions also teaches us laws , leave religions even the different ‘castes’ have their laws , they may be right or wrong but I am not here with this , I am saying that laws are everywhere , you cannot define it in simple words.
So there are many laws rather I say set of rules and regulations, so whom will we say law, now what will be definition of law, the same question which I raised before is here now. So to conclude I would like to say that:
“LAW IS A SET OF RULES AND REGULATONS, WHICH ANY POWERFUL BODY SITTING OVER US IMPLMENTS, WHICH DEALS WITH THE GOODWILL OF OUR LIFE, WHICH SHOWS THE PEACEFUL AND SOLEMN PATH OF A PERSON’S HAPPY LIFE IN THIS UNIVERSE”
Why LAW is needed? And do we really need law?
With the above discussion we understand many things and there were where I discussed I why law is needed, i.e. for human conduct. But here question arises that “do we really need law?” Again answer is not simple one, it is also a very complex question, but we have to find an answer . To support this view that law is needed one can argue that human is not kind, it will create problems in society that’s why we need law. But can we say that it is 100%true. No , I can argue that there are desires in human being for his luxiorus life and when society prohibits him/her , the dark impulses comes out and take control of human life , and here law is required but if society will not prohibit no law is required. But this also not true that human can leave without law, because there are ample of instances which shows that without law anarchy prevailed (for e.g. riots arose when law officers gone on strike). To support this view I would like to add here the points ‘JHON LOCKE” he says that human is kind, helpful. So we also can’t simplify this one too. We can say that
“Law is required because locke also says that there are some violent items in the society, to control anarchy, who believes that god created society, god also made some rules that’s why we can say that law is required.”
It’s becoming too long , so here I stops , and hope that I am able to reach to you people , and there are some questions which are left unanswered , that I will deal next time . And please help me to improve.
